Qualification
In general, if a person started working for you over 40 weeks prior to the estimated date of birth or placement date and earns the Lower Earnings Limit for NI a week or more they are entitled to receive SMP and SAP. All employees are entitled to take Maternity or Adoption leave regardless of length of service. Do not confuse the right to take a period of leave with the right to be paid for it. A contract of employment can enhance these rights but not diminish them.
To qualify an employee must:
- earn the Lower Earnings Limit for NI or more
- pay national insurance contributions if their wages were high enough or the employer pays national insurance contributions on the employees wages
- have been employed for a period of 40 full weeks or more prior to the expected week of confinement (date on the MAT B1 form) or the date of placement of an adopted child
- have given you notice of their intention to take leave on or before the 15th week prior to the expected date of birth or placement date
- be 16 or older and younger than 65 (male or female)
